Background and Context
Attacks on education include acts of violence against education institutions and learning sites. These attacks include shelling, targeting for propaganda and occupation as well as threats against students and teachers. In addition, attacks, as well as threats of attacks, can cause serious and lasting harm to individuals and societies. Access to education may be compromised, the functioning of educational institutions may be impeded, or teachers and students may remain at home, fearing for their safety. The use of educational institutions for military purposes may increase the risk of recruitment and use of children by armed actors or expose children and young people to sexual abuse or exploitation. In particular, it can increase the risk of attacks on institutions dedicated to education.
. We will do our utmost to ensure that learning spaces are safe. The school can also be a great place to educate children about disaster preparedness, to teach them how to react in an appropriate and organized way, and to teach them some precautionary measures. The multiplier effect of child sensitization within the community is significant and sustainable. Important work is therefore needed to ensure the safety of schools and their surroundings, as well as the paths leading to them. School staff, Community education Committee (CEC) and all members of each school community also need to be widely trained on the basics of child protection, on the Protection of Schools and Universities Guidelines and their use by the Military during Armed Conflicts so that violence and abuse are banned from school and that school always keeps its neutral and apolitical character. As part of its efforts to disseminate and operationalize the Guidelines on the Protection of Schools and Universities from Military use during armed conflicts, the ministry of education seeks to recruit a national consultant to examine the Somalia’s legal framework and policies on the protection of education and put in place a guideline for an improved framework adapted to the context of access to education during crises and armed conflicts. The national consultant will collect relevant and reliable data on existing laws and policies in Somalia to accompany the process of integrating the guidelines into national policies and in all necessary and possible operational frameworks.
Based on the above-mentioned premise, the objective of this assignment is to prepare a policy framework and implementation guidelines to advocate for establishing and expanding safe schools’ operational guidelines for Somalia. This policy framework would be developed based on both secondary analysis and primary data collection. The development of this framework should be highly consultative and include community, civil society and other line ministries.
- Conduct a situational analysis including:
- Primary data collection and
- Review of available secondary data and documents
- Consultation with relevant stakeholders
- Prepare a school and universities protection Guideline Framework based on the review
- Prepare a detailed guideline for implementation of the policy
Duties and Responsibilities
The Consultant will complete the following tasks:
- Develop work plan and inception report
- Complete a desk review assessment
- Carry out interviews with key stakeholders and collect data from the field
- Prepare situational analysis report
- Develop Policy framework and guideline based on situational analysis
- Share the draft policy and guideline with stakeholders for comment
- Finalize the report based on inputs from stakeholders
- Develop an implementation plan
· The Draft 5-page policy framework is ready for layout and printing that will summarize a 20-page document that will be developed as a source document for reference in electronic format and including an executive summary of no more than 4 pages.
· Detailed implementation guideline, with timeline and accountability framework and a 30-page document in electronic format.

The consultant will be managed by department of schools in MoECHE with technical supervision by SSD Task Force members.
Required expertise, qualifications and competencies
Functional Competencies – At least Master’s degree in public law or any other recognized equivalent degree relevant to the subject;
· Minimum of 10 years’ experience preferably in policy development and analysis
· Have knowledge of the management of threats against education in situation of crises, conflicts and post conflict in Somalia, – Capacity to communicate effectively and write reports, and experience in consultation with local, national and international actors;- Excellent oral and written communication skills in English and Somalia;- Ability to communicate and work under pressure in a multicultural environment,- Have at least ten years of proven experience in development/ humanitarian sector, monitoring and implementation of legal texts in the field of the legal and institutional framework or any other related field;- Experience in education and child protection is an advantage.
· Ability to be flexible and respond to changes to text as part of the review and feedback process;
· Strong interpersonal skills, able to communicate and work with diverse people
· Participate effectively in team-based, information-sharing environment, collaborating and cooperating effectively with others;
· Focus and result oriented
The payment schedule will be as a lump sum based on work performed. The payment schedule based on acceptance of the deliverables
Termination of Contract
This Contract shall commence on the Commencement Date and terminate upon payment of the final instalment of the contract cost; provided however that either Party may exercise its right to early termination in accordance with MoECHE contractual guideline
